Consumer Trader and Tenancy Tribunal (CTTT)

 

The Tribunal was set up in 2002 as an independent body to hear disputes about Strata and Community schemes, residential tenancies, home building and other matters that involve consumers. The tribunal is a specialist, independent, low cost tribunal designed to be fair and resolve disputes in a timely manner according to law.

 

All Strata Solutions can help you in your preparation, before taking a matter to the tribunal. It is far more cost effective to have our legal team assess your problem before involving a court process where the result may be uncertain, or you may loose control of the issue.

 

The most common forms of disputes that are taken to the tribunal involve:

 

  • Appointment of Strata managers and caretakers

 

  • Exclusive use by-laws, selectively applied by-laws or changes to by-laws

 

  • Damage or use of common properties

 

  • Levies and contributions to sinking funds

 

  • Pets and the keeping of animals

 

  • Building and construction disputes

 

  • Excessive noise or rowdiness by lot owners.

 

 

The Tribunal will hear and adjudicate disputes on behalf of Strata titles, Community Schemes, Owners Corporations, and Lot Owners or occupies of Lots. The Tribunal will have an Adjudicator assess most disputes. The parties to a dispute or those affected by the orders sort will be encouraged to make a written submission and then the adjudicator will make a decision.

 

All strata solutions mediation team can assist in this process before making an application to the tribunal. Our dedicated alternative dispute resolution team will provide you with a structured process to try and achieve a mutually agreed settlement that may save everyone a lot of time effort and emotional distress.

 

In the alternative, in most disputes that come before the Tribunal, the Tribunal will encourage a form of mediation. The tribunal has qualified conciliators that will assist and encourage the parties to engage in conciliation or mediation which will then be endorsed by the registrar if agreement is reached.
