Alternative Dispute Resolution

 

All Strata Solutions realises that community living brings together a vast array of diverse people with different interest's backgrounds and expectations. Our team of lawyer's, accountants and property specialists have extensive experience in alternate dispute resolution processes. Alternate dispute resolution is an umbrella term to describe various ways of resolving disputes, which don't necessarily involve going to court.

 

All Strata Solutions team has identified, that often problems are a result of lack of communication between parties. It is a fact of life that disagreements and disputes occur in everyday life, they tend to fester and grow primarily as a result of isolation or non communication of problems with your neighbours, contractors or strata managers.

 

All strata solutions can be a positive influence on the process preferring dialogue over litigation.

The four main types of alternative dispute resolution are:

 

1. Mediation

 

  • An informal negotiation process in which a neutral mediator assists those involved in a dispute to achieve their own settlement.

 

  • The mediator does not impose solutions.

 

  • The parties ultimately come up with their own solutions to settle the dispute.

 

  • Assists parties to agree on some issues and narrow down the issues they do not agree upon in case court action is needed.

 

2. Arbitration

 

  • Parties to a dispute present arguments and evidence to an arbitrator.

 

  • The official arbitrator then makes a determination.

 

3. Conciliation

 

  • The parties hire a conciliator to help them reach agreement.

 

  • Advises on the context or likely outcome of resolutions but does not make binding decisions.

 

  • Can suggest terms for settlement or offer expert advice on likely settlement outcomes, actively encourages the parties towards resolution.

 

4. Negotiation

 

  • Does not need solicitors or third parties.

 

  • Use of representatives such as lawyers who come to terms on behalf of clients, may involve a facilitator.
